Section 59 is UNLAWFUL
So I got some grief at my spot on Sunday by 2 rounds of cops.
Refused to give my details to the first ones, asking if I was obliged to give details, being on a private car park and there not being an injured party, no claim against me, no breach of the peace. YOUR NOT OBLIGED TO GIVE DETAILS in that instance.
The second lot were a pain in the *** though.... did the same, but every time I thought I'd covered the argument, another cop would start up again from another angle.
eventually they threatened arrest and seizure of my bike even though there was no breach of the peace, no injured party and no claim made against me, I had permission to be there. annoyed at myself for not sticking to my guns!!!!
Fukin scum bags.

hit me with section 59 warning, " causing alarm or distress to the public"

I feel ur pain dude in surrey there is a slightly harsher version of a section 59 first part is a warning , second is bike/car impounded and wait for it.... Anti Social Behaviour Order is slapped on you. I received a warning for speeding past a stationary police car and they couldnt prove I was speeding. I stupidly gave them my real details and received the warning which they can give for anything they deem anti social behaviour using a vehicle.
Whatever you do though i would get in contact with the area commander and see if u can have the warning removed try to be factual and not emotional ! i know it will be hard with these ***** but its the only way you would have a chance at having it removed. As they have given a warning if they "catch" you again they can seize the bike
. Anything you can use to your advantage I.e Using a standard can average rpm average decibels in comparison to masonry workk etc that can help your arguement would be useful. Safety proceedures ie should a member of the public approach the car park you would cease all activities etc. It will be hard to do but i think it could be done if you concentrated on the safety aspect. The alternative is deny you were doing anything except practice road manoeuvres in a safer environment.The more facts and solid arguements you throw in the better make sure you get a copy of the police complaints process.

Wow Nick, i'm suprised you give in and give them your details. I know its a ball ache getting dragged down the station and then getting your bike back (but you would get it back, they cant take it), but why do they have the right to know your details? They are there to serve and protect us. NOT to bully us. They are no more powerful then me you or the tramp living in a tree. They use tricks to bully us into giving them what they want. I may book a few days of work and come and ride with you. Lets see how they feel when "WE" gang up on them.
If they asked if it was your bike, did you so "no"?? its DVLA's, i just look after it for them??

I know mate. I'm annoyed I gave my details, but it was tough with 3 of them on me and when they threatened to steal my bike I changed my mind. First time I've had proper grief and I folded 
they are sneaky lying gits! 
Now I've done my homework, if there's a next time I'm totally standing my ground. I did nothing wrong.
Also looking in to de-registering my bike and or van too. take it out of their juristiction. Some good info just out on the http://www.lawfulrebellion.org/

sounds like you know your rights and know the law which has helped ya,think i need to start brushin up on all that lol,there a bunch of *****'s tho as far as im concerned,ive had 3 now,they impounded my bike on the last one,£150 to get my bike out the impound,got the last one for putting my leg out goin around a roundabout! pmsl,abuse of power or what! ,section 59 is anti social behaviour with a motor vehicle as far as they told me on the previous two,cant see how havin my leg out is anti social behavour....
can you insure your bike if you decide to not register it ? because they told me when i picked my bike up from impound they mainly crush vehicles without insurance after so many section 59's and they dish em out even when on private land if theres public access,which unless you got a 20 ft electric fence around your spot they'll probly say its got public access , its a complete joke...i think its just a power thing with the majority of the *****'s who join the police,yeah fair enough if your wheeling past schools or through town centres lol but in car parks were no one goes,it should be down to their discression,even then tho i suppose most of the arseholes would dish em out for their pleasure cus they can....

Insurance is an issue if you de-register a vehicle. It's gets quite deep in the rabbit hole. The rough deal (current thinking) is that when a vehicle is REGISTERED with the DVLA you somehow transfer ownership of the vehicle to the DVLA and they let you use it as long as you follow their rules on the road. i.e. they reckon you've contracted with them. This is why they sometimes get away with stealing and crushing a car without being accused of theft - becuase they already own it. There's lots ofpeople researching this field and it's well interesting.
I think what you need to do iis to 'export' the vehicle out ofthe UK jurisdiction, not the geographical region. and you send the DVLA (+copies to police and govt) a legal document of your sworth truth called a NOTICE of Understanding & Intent and a Claim of Right (NOUI&COR) including a FEE SCHEDULE, which explains that it's you'r provate property, you are exercising your common law right to travel and anyone who interfers with it will be charged for doing so.
If you want to start learning sign up to www.tpuc.org - I highly recommend it. Lots of people starting to ask questions that the 'authorities' are struggling to answer.... the curtain of lies and deceipt is lifting and people are actually starting to understand what fredom is.

Well the police has slowly turned into the the same thing. But with a Robbin Hood twist. They will Rob you or every last panny, scare you into owning up or telling them somethin they have no right to know about. They bully any and everyone, twisting lie's along the way and looking out for each other where needed. As for the Robbin Hood bit, well sometimes they catch a peedo, but only sometimes. The prisons are full of people who they can NOT make money from i.e. job less chav's. Anyone who works or has money is a target. If you own a car or a bike or a house YOU are a target.

My brother is highly likely to be getting a ban soon, as he owns his car, pays insurance and works.
On traffic cops, every week a Somalian gets let on his way, with a boot full of drugs, no licence (using his cousins), no tax or insurance and was speeding, while running through a pack of kids.
No respect for them anymore.
House got burgled years ago, took them 6 hours to turn up (ok its not an emergency anymore, but my parents are off work waiting for them, so losing more money) and the first thing they said was 'Do you know the number plate on that car is illegal' about my brothers bike sized plate on his car
My Ma went mental at them
They also used to chase after us for doing wheelies, ON OUR PUSHBIKES!!! wtf.
But when they pull me up, im just polite, and they always end up talking to me about how to do wheelies

I'd buy a copy of an Oxorfd Law dicitonary (or go to the library) and check the definitions of words, like ROAD etc because there might be some nice tit-bits to help you out.

My driveway is 'open to public access' because there is nogate, but any registered (or otherwise) car parked on it is not subject to the statutes and act of the UK. i.e. it doesn't need to be taxed, insured or MoT'd.
It sounds like double standards to me.

thanks for help nick i think the main problem is that its a tesco car park and there was a car meet but i do have a good solicitor and they gotta prove it as its 1 copper vs me and 2 witnesses

i am buying that keyring one cos the copper did not caution me and said he only heard screeching but now in his statement he saw me wheelie and skidding and aparently cautioned me so in future i am gonna use this recorder thing wenever i get stopped

Really good info Nick. Got a phone call form the police yesterday about pushing a guy off his bike in april (he booted my van as he rode past!).
Remembered this forum and just told them to come and arrest me if they can because i haven't got time to be mugged off at a police station.
This issue needs to be highlighted alot more as if i hadn't read this thread i would've blindly been lead into their trap.

Ps. Im always going to get fucked by authority and society in general so my policy is 'if your going down, go down swinging' at least then you'll have something to show for it.
