We've been stunting at this spot for about 5 Sundays in a row and the owner gave us verbal permission to be there, he just said if you crack a case clean up the oil and if eat clean up the trash when you leave. Now we've had the cops come there the last 2 Sundays and now that the owner is getting flack from the neighbors complaining about noise, he re-nigged on his agreement with us and will not sign a written agreement.

So we had to find a different spot. Too bad to, because that was a smooth surface with lots of distance and right near two of our teammates house's.

Anyway we've got a spot we go to that we have not been kicked out of all last summer and we were there for about 5-6 hours a day every Sat and Sun.

this is really solid

my business law teacher said the key to signing away your liability is to make the person understand the inherent risks.. you cant just sign something not to sue under any circumstances. you have to say 'skiing is dangerous because you can hit things for these and other reasons'.

can you post the liability form?????? or send it to martinosvath@msn.com

WAIVER AND RELEASE OF LIABILITY



In consideration of The Dunes, Inc. furnishing property to enable me to participate in motorized off road vehicle activities, I agree as follows:

I fully understand and acknowledge that: (a) risks and dangers exist in my use of motorized off road vehicles and my participation in motorized off road vehicle activities; (b) my participation in such activities and/or use of such equipment may result in my injury, including but not limited to body injury, fractures, partial and/or total paralysis, eye injury, blindness, death, or other injuries that could result in serious disability; (c) these risks and dangers may be caused by my own negligence, by the negligence of the owners, employees, breaches of contract, the forces of nature or other causes. These risks and dangers may arise from foreseeable or unforeseeable causes; and (d) by my participation in these activities and/or use of equipment, I hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of myself, the owners, agents, officers, employees of The Dunes, Inc., or by any other person.

I, on behalf of myself, my personal representatives and my heirs, herby voluntarily agree to release, waive, discharge, hold harmless, defend, and indemnify The Dunes, Inc. and its owners, agents, officers, and employees from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of motorized off road vehicles or my participation in motorized off road vehicle activities. I specifically understand that I am releasing, discharging and waiving any claims or actions that I may have presently or in the future for the negligent acts or other conduct of myself, the owners, agents, officers or employees of The Dunes, Inc.

In signing this release, I hereby acknowledge and represent that I have informed myself and made myself fully aware of the condition of the terrain and the trails at The Dunes, Inc., either by prior participation or by investigation into the trails and/or terrain.



I HAVE READ THE ABOVE WAIVER AND RELEASE AND BY SIGNING IT AGREE IT IS MY INTENTION TO EXEMPT AND RELIEVE THE DUNES, INC. FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.
