photography isn't a crime, recording audio without notifying the parties involved is a crime unfortunately
that's only pertains to legitimate reasonable expectation of privacy like phone conversations and persons residence. there is no expectation of privacy in public other then restrooms an' changing rooms provided by public or business. Police and government officials have no reasonable expectation of privacy in public while on duty, technically that goes for anyone. 99% of the time a judge will toss the bogus charges. the corrupt cops will continue to do this anyways just to intimidate the public and try to ruin your day by tossing you in jail and in most cases your equipment will be tampered with by the time you are released from jail so don't be surprised the memory card was lost or erased...
I'm not saying all cops are like this because there is a few good ones out there that couldn't care less if your taping them it's the ones that have a bug up their *** that are usually corrupted
