reckless driving

I live in a shitty *** town in Iowa where there is only two parking lots we can stunt at. I was stunting one day and an unmarked officer came up and said that if a marked police officer was to come out he could give us a wreckless driving ticket. The parking lot we are in is an old walmart parking lot that has been abandoned for 10 or more years no one is ever in the parking lot besides us and maybe some spectators every once in a while. Yesterday a marked police officer drove throught slowly looking at us stunting then left the parking lot and positioned himself across the road so the front of his car was facing the parking lot, the perfect way to sit to have the dashboard camera catch everything we do on tape. We stopped doing stunts when we saw the officer and decided to go to another lot. Can he give us reckless driving has anyone ever gotten in trouble at an abandoned parking lot?

Yes they can... I dont think they will. I have seen cops stop and watch alot and not do **** matters if they are bitches or not. If they dont want you there they will just tell you to leave.

i wouldve just rode over and talked to the cop. tell him youre staying off the street not wanting to endanger anyone. he was prolly just watching. establishing a positive "relationship" with as many cops as possible will minimize your chances of getting a reckless at the spot. its all in how you present yourself to him.

Arrest for Criminal Trespass requires the property owner to ask you to leave, then you refuse to leave. Off-duty cops are often contracted as private security guards for apartment complexes by a discount in their rent, so they might not be in uniform.

In theory, so long as you are on private property, police cannot arrest you for trespass without the property owner's permission, at that exact moment, in person.

Enforcing an unconstitutional law in a provate parking lot can probably be beaten on appeal, by someone already skilled at winning in court, whether a lawyer or not.

Best to not do ANYTHING with police watching, especially if cops are videotaping. Best to NEVER talk to police, unless you have your own audio and video recordings, but beware CONFESSIONS.

Every town needs a stuntbike parking lot, funded by city taxpayers, just like government ball fields (Little League to $250-million pro stadiums). Go speak at your local city council and work to get a free stunt park in your town. This parking lot can also be used for police training, drivers ed, car shows, autocross competitions, etc.

AN ACT to amend Tennessee Code Annotated, Title 55, Chapter 10 and Title 55, Chapter 8, relative to reckless driving. BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: SECTION 1. Tennessee Code Annotated, Section 55-10-205, is amended by adding the following as new subsection (b) and by relettering the existing subsection (b) accordingly: (b) A person commits an offense of reckless driving who drives a motorcycle with the front tire raised off the ground in willful and wanton disregard for the safety of persons or property on any public street, highway, alley, parking lot, or driveway, or on the premises of any shopping center, trailer park, apartment house complex, or any other premises which are generally frequented by the public at large. Provided, the offense of reckless driving for driving a motorcycle with the front tire raised off the ground shall not be applicable to persons riding in a parade, at a speed not to exceed thirty (30) miles per hour, if the person is eighteen (18) years of age or older. SECTION 2. This act shall take effect July 1, 2007, the public welfare requiring it.

Note that "willful and wanton disregard for safety" is an "essential element" of the crime, so one could argue in court that since no one was injured and safety precautions were taken, THERE WAS NO CRIME.
