court question when pleading not guilty

was cited with a reckless a few weeks back, my court hearing is monday. im pleading not guilty so my question is, once i plead not guilty will they reschedule my hearing for another date or look at the case on the spot?

the reason im asking is i was cited for 66 in a 35, on a road that has no reason to be a 35.. stupid *** virginia. anyway im pleading with faulty equipment, my speedo is way off with -1, +10 gearing and i never even bother to look at what it says because of that. i need to get my bike calibrated yet just to have proof but it has been out of commission since i looped it a couple weeks ago and im still waiting on parts to arrive.

also i just got off the phone with the ppl at the court house and they won't let me reschedule.

so if i walk in and say "not guilty" will they just have me leave and give me time to get my bike calibrated to prove my point or continue with the case while im there?

tell them you are pleading not guilty and need time to get a lawyer.... you're better off paying a lawyer to take care of it....

It all boils down to money...

well i already had the "advisement" hearing or whatever they call it where i told them i didnt want a lawyer. the reason i dont want to pay for a lawyer is im only in VA for school and i have a PA license, so i wont get any points or anything since PA and VA dont work together (thats how its worked in the past) i should just end up with a fine, but im just trying to have the case dropped from a reckless to a speeding so i have less of a fine to pay.

Yea plea not guilty, then you have the option to speak with the prosecutor that day, or come back usually like a month later to talk to the prosecutor. Try to get that **** drop down to like civil speeding or something. If you have a pretty good record, most of the time they will.

Usually they will give you a plea-bargain of some sort and lower it. But it all kind of depends on how/what happened at the scene. On the back of every ticket the police officer puts private notes that either (A) the D.A. will read or (B) the judge will read. If you were an ******* when you received the ticket then more than likely you won't get **** dropped. Every state is different so you could be fucked since it's just a fine and EVERY state is GREEDY!!!

that used to be the case between commonwealth states. not anymore. they have started to transfer points.

they will probably plea bargin with you. you pay them, they give you something without points. ask for a 3111A its no points.

Honestly a lawyer is your best bet. Iv spent alot and i mean alot of time in the court room For alot of things as well as wreckless driving.
And i would tell them your in school and need some more time cause its taking time for you to get the money together for one.

unfortunately i've spent a good deal of time in a court room too as a defendant. as others have said get a lawyer. he will work a deal with the state. the lawyer shows you care what happens to yourself. it's the only thing that separtes you from the monkey *** career criminals, those guys don't get slack they go to prison or lots of probation so eventually prison. i didn't read what you did but if it's anything more than a speeding ticket you need someone to represent you. i should have went to prison already but i got off on probation, violated that 5 times, with new charges. got reinstated everytime and eventually early termed. all thanks to a lawyer. :YEAH i could have prolly bought 4 bikes with all the money spent but it's better than stampin license plates.

i already gave away my right to a lawyer, they even made me sign some stupid paper.. maybe that was a mistake. im usually really polite and corporative with the officers so im not worried about that, although it was a woman officer with too much power that went to her head and she was a bitch, but i was still nice hoping id get off with a warning.

im poor as **** right now being a full time student and i have almost 0 income. i have a speedohealer sitting here somewhere what if i take that in and show them i have the part to fix the error, and bring a pic of my bike all tore apart right now and tell them i need more time to get the bike back together to get it calibrated and fixed? thats the best thing i can think of right now.

i would do that, provide some kind of reciept of proof of purchase of the speedo healer and that your making efforts to fix the problem despite the fact your a poor college student... chances are they've all been there.



oh and if all else fails, just ask the judge if you can have sex with her. That usually works.

tell them ur a student, take pictures of the bike, kiss some ***, try to have it fixed for when you go to court. since you don't have a lawyer just tell them that you are a broke student and let them know you give a **** what happens to you and they will usually go easier on you. but if you just walk in and take what's comin you better prepare urself. you'll be alright.

In CT you go in and enter a plea with the prosecutor, anytime I've gone they'll drop it down to a lesser charge if you plea "guilty"...you go in front of the judge and plea guilty, pay the court fees and your done. A "not guilty" plea for a reckless driving charge will just end up costing you more time and money...they have no interest in your gauges not being calibrated. If it was a DUI or worse maybe a lawyer would be worth it...just my

if you can afford it get a lawyer. if not, tell'em your speedo must be wrong. they will give you usually a month or so to get it recalibrated and tehn either reduce the fine or tell you to go home. Mind you this is based on my experiance only, not actual law or anything like that.

Everyone here has personal experience which is all fine and most of the advise is ok....but here is the problem.....you are in VA.....I happen to be fairly familiar with VA Traffic Law....

1st. The speedo calibration defense - don't even try it. It will get you no where.
2nd. VA is seriously enforcing reckless driving charges....for instance my ex just got 10 days in VA jail for reckless.
3rd.. NO MATTER WHAT YOU SIGNED YOU CAN ALWAYS CHANGE YOUR MIND AND YOUR RIGHTS ARE PROTECTED UNDER FEDERAL LAW SO YOU CAN ALWAYS GET YOUR RIGHT TO A LAWYER BACK AT ANY TIME!
4th. Get a lawyer and listen to his advise not anyone elses...local lawyers are familiar with the local judges and prosecutors and can determine the best course of action for that area.

so do you guys think i should try and get a lawyer? i really dont have alot of money and i was just trying to get the reckless dropped to just a speeding ticket or something else of the sort that would cost me less. how much would you guys expect a lawyer would cost for my case?

other than a couple speeding tickets my record is clean, putting somebody in jail for a stupid speeding ticket is retarded, although i do know of a kid who got locked up 3 days for driving 100+ in a 65, not sure of his previous record but i dont think he had much.

VA is ridiculous as soon as im done with school im getting out of this **** hole.

don't do the crime if you can't do the time, and if you scared go to church. get a lawyer and don't brake the law.
