who here has ever sued anyone?
small claims court.
im about to sue someone for the first time ever. curious how it all goes down..
****** owes me 2k...
i got a contract he signed and is in total breeeeech...

never sued any one but you better have proof you satisfied the contracted agreement and pm awOno he is in law school so he should be able to give you some good advise

2k is 2k and even if it takes a year.. i want my 2k eh!?

i was told u can include lawyer fees in the claim.. well see..
like i said its more principal than anything
if it costs me 3k to get my 2k.. ill do it.. :P

Kane....Yes...
1st. It's very easy to sue an individual or business in small claims court....You should enter the misdomeanor court hose in the jurisdiction the contract was signed...Primarily where the business is located....County or state court house...
- there will be a small claims packet to fill out then turn in with a fee...200 - 400 dollars...Approx
- Small Claims is VERY easy...Little proof is needed the amount needed to win a civil small claim is "Proponderance of the evidence" Which is like 51% to put it im numerical form...that means if you can prove/make the judge believe you are at least 51% in the right you win!
-Written proof is great, verbal works, personal notes can help and witness's are usually good too.
Contracts are usually pretty easy and cut and dry...but anything can happen...
Lawyer's are ok but in small claims they usually are not worth the $$$ and they are not needed!
Small Claims court has a cap of usually 5000 or less...that is usually not enough for most good lawyers to even talk to you...

Kane hit up Jason (Motovegas) on the 702 forums, he is a lawyer, and if he cant do it he will find someone in his company to help you, and give you a decent price at that.
If anything came down to it he could help you set up the paperwork.
I know a lawyer and I can talk to her sunday if you want me to.
And I will find out what all you need, and what you need to get it togeather.

if that was the case youd have a class action suit against you and your fake *** ganta videos long ago...
only thing ur killing in the stunt world lately is $5 bin at walmart son...
ur all but W A S H E D up and gone... before it even started...
i remember when i used to have a competitior named darius that murdered it.. now all i got is a retired teacher and a 16 year old.. where u been fruit loop?

The only exception is where there is a provision in the contract for arbitration or directing the jurisdiction where all disputes should be settled.
Since you have a written contract the statute of frauds is satisfied, so all you have to show is that you met your part of the agreement...the court will award you what you are owed or the defendant will ***** out when he gets served with the suit and cut u a check to settle.
Restitution is available to you because you performed a service believing that there is a binding contract. In order to be granted restitution, you must 1)demonstrate that defendant received a benefit, 2)that by receipt of that benefit he was unjustly enriched at your expense, and 3)that circumstances were such that in good conscience he should make compensation.
